ขออนุญาตถามนะ ครับ

 ผมเองทำงานให้กับบริษัท A ซึ่งเป็นบริษัท outsource, บริษัท A ส่งฉันมาทำงานให้กับโปรเจคท์นี้ ให้กับ บริษัท B

ด้วย สัญญา contract 1 ปี กับ บริษัท A ซึ่ง ก็ จะหมด contract กับ บริษัท B เช่นเดียวกัน

แต่ เมื่อใกล้หมด สัญญา ทาง บริษัท B ก็ จะทำการต่อ สัญญา ออกไปอีก 6 เดือน

ทำให้ บริษัท A ต้อง ทำการต่อ สัญญา สำหรับผม เพื่อให้ทำงานที่ บริษัท A ต่อไปอีก 6 เดือน ซึ่ง สัญญาที่บริษัท A ต่อกับผมนั้น เป็นแบบ พนักงานประจำ

หลังจากหมดสัญญา ที่ต่อมา 6 เดือน กับ บริษัท B แล้ว ผม ก็ได้ว่างงาน( ประมาณ 2 เดือน นั่งเล่นเนตใน office ) แต่ก็ยังได้รับเงินเดือนจาก บริษัท A เพราะว่าเป็นพนักงานประจำแล้ว

และในตอนนี้ บริษัท B ได้ทำการติดต่อกับ ผม โดยตรง เพื่อให้ไปเป็นพนักงานของบริษัท B

แต่ยังไม่แน่ใจเรื่องสัญญาจ้างที่ทำไว้กับ บริษัท A จึงอยากขอรบกวนถาม สัญญาส่วนที่เกี่ยวข้องมีดังนี้

 1. สัญญา เมื่อตอนเป็น contract 1 ปี

ระบุไว้ว่า

....a contractual period of 1 Year with effect from February 14 ,2011... <<< วันเริ่มงานครับ ซึ่ง จะต้องหมด สัญญา ในวันที่ February 13 ,2012 >>>

และมีเงื่อนไขอีกว่า

For a period of one year following the termination of your employment for whatever reason (which time period shall be extended by the length of time during which you are in violation of this paragraph), you shall no directly or indirectly;

a) solicit the business of any customer of the Company (or otherwise deal in a manner adverse to the Company with) or provide any service to any customer or prospective customer (whom you have personally dealt with during you employment);

b) solicit the service of (or otherwise deal in a manner adverse to the Company with) any employee of the Company or induce such employees to terminate his or her employment; or

 c) carry on or be engaged or interested in any capacity in any other business, trader or occupation whatsoever, except in a business, trader or occupation which does not compete with the core business of the Company, except as disclosed or declared in writing to the Company prior to the date of this Agreement

2. สัญญาเมื่อเป็นพนักงานประจำ

   จะไม่มีการระบุในสัญญา แบบในข้อ 1.

แต่จะมีข้อความ ว่า All other terms and conditions of your employment will remain same.

ในส่วนนี้จะหมายถึง สัญญาในข้อ1 หรือไม่ครับ

คำถามคือ

·         ผมจะย้ายไปทำงานกับบริษัท B ได้หรือ ไม่ครับ จะเกิดปัญหาหรือไม่
